Sobriety checkpoints are legal here in Indiana, so many drivers here have been through what actor Vince Vaughn did at a zero tolerance checkpoint at 12:30 a.m. between Hermosa Beach and Manhattan Beach, California.
According to CNN, The 48-year-old actor was taken into custody on suspicion of misdemeanor DUI and for resisting, delaying or obstructing officers. His unidentified male passenger was arrested for public intoxication and obstructing officers for refusing to get out of the car when they were first stopped at the checkpoint. The Manhattan Beach Police Depart later added that the resisting arresting was not physical, but rather a delaying of the investigation.
Checkpoints sometimes announced
Police sometimes announce their plans to create a checkpoint in attempt to curb drinking and driving, particularly on holidays. While it wasn’t a holiday, the Manhattan Beach Police Department announced that there would be a zero tolerance checkpoint that night. Zero tolerance means that anyone over the legal limit for blood alcohol level would be arrested.
Other reports detail that Vaughn was spotted at a party in a bar between 7 p.m. and 10 p.m. with a drink in his hand. Vaughn later chose to submit to a blood sample rather than a breathalyzer. The results have not been released.
Did Vaughn right approach?
The circumstances of each DUI are different. Not all the details of Vaughn’s arresting have been released, but it is safe to say that the actor mostly took the right approach. Trying to avoid the checkpoint by turning around is considered erratic driving and would have sent red flags to law enforcement. Getting into a physical confrontation with police is never a good idea, but even talking back to officers will result in additional charges, as Vaughn found out. It is also worth noting that the blood level is more accurate than a Breathalyzer test, so perhaps the actor hopes that his name will be cleared with an accurate reading.
